The terms on which Fresh Deal Exim provides quotations, products and export services.
Quotations are indicative until confirmed in a signed Proforma Invoice. Prices are subject to change with market conditions, freight rates and specification changes. An order is confirmed only when the Proforma Invoice is accepted and the agreed advance, LC or CAD instrument is received.
Approved samples define the quality reference for the order. Standard samples are usually supplied free of cost with courier at the buyer's expense; custom and private-label samples may carry a development charge, which is advised in advance.
We work on LC at sight, TT (typically part advance and balance against scanned Bill of Lading), CAD, or 100% advance for sample and trial orders. The applicable terms are stated in the Proforma Invoice.
Products are supplied to the agreed specification, with normal trade tolerances for moisture, broken percentage, colour and natural variation in commodities and handicrafts. Any claim must be notified in writing with supporting inspection evidence within 14 days of arrival at the destination port, and the consignment must be retained for inspection.
Dispatch dates are estimates made in good faith. We are not liable for delays caused by circumstances beyond our control, including port congestion, shipping line schedule changes, strikes, customs actions, natural events, epidemics or government restrictions.
For private-label and OEM orders, the buyer is responsible for ensuring that brand names, artwork, logos and label content supplied to us do not infringe any third-party intellectual property rights, and grants Fresh Deal Exim the right to reproduce that material on packaging for the order.
These terms and all transactions are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of Indian courts, unless a separate written agreement provides otherwise.
